EU–U.S. Privacy and Swiss-U.S. Privacy Policy Pledge

Overview

PeopleONE Inc. respects your privacy and complies with the EU–U.S. Privacy and Swiss-U.S. Privacy Shield Principles as set forth by the U.S. Department of Commerce regarding the collection, storage, use, transfer, and other processing of Consumer Personal Data transferred between the European Economic Area (“EEA”) or Switzerland and the United States.

Expertus does not receive data directly from consumers. This policy sets forth the manner in which such data is used and secured by Expertus.

EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework

PeopleONE Inc. complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, respectively. PeopleONE Inc. has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Privacy Pledge

Expertus respects your privacy. We want you to feel secure when visiting our website and we’re committed to protecting the information you share with us as you interact with this site, or communicate with us through other channels.

Therefore, we’ll never collect, use, share or sell data that personally identifies you, without express permission from you in advance. In fact, the only way we capture sensitive information from you is through voluntary digital forms- and we don’t make this information available to any outside parties.

Periodically, we may collect activity data from our web servers for internal reporting and analysis. This information does not identify individual visitors.

Adherence to Privacy Shield Principles

At a minimum, however, Expertus, Inc. handles all Data in accordance with our EU–U.S. and Swiss-U.S. Privacy Shield, which is based upon the privacy principles identified in the Policy Shield Privacy Framework.

This Notice addresses data subjects residing in the EEA (“EEA Persons”) and Swiss individuals whose data we may receive from one of our customers, suppliers, or other business partners in the EEA or Switzerland, e.g., referral partners, integration partners, etc. When Expertus, Inc. receives any Data for processing pursuant to instructions of clients or their partners, we are acting as an agent for our client and do not provide notice to individuals regarding the collection and use of their personal data. Our clients remain responsible for providing notice, if and to the extent they believe such notice is necessary under applicable EU and Swiss law.

Business Purposes for the Collection and Use of Personal Data

Expertus does not receive data directly from consumers. Generally, Expertus’ clients are processors or merchants selling goods and services. Expertus may receive consumer data indirectly via its clients.

Use of the data received

Expertus may take stored data available to government officials in response to a subpoena or other comparable lawful and compulsory request. Except as described herein, Expertus does not make the data received available to any other third parties.

Principles of the EU–U.S. and Swiss-U.S. Privacy Policy Shield Framework

Disclosure Information

Expertus does not sell, share, or disclose any information provided to us.

Notice

Expertus encourages its clients to provide their customers with notice of Expertus’ role in processing the transaction data.

Onward Transfers

Expertus does not make any onward transfers of the data it receives to any third party companies. The data can only be transferred back to the entity from which it was received.

In cases of onward transfer to third parties of data EU and Swiss individuals received pursuant to the EU–U.S. and Swiss-U.S. Privacy Shield, Expertus is potentially liable.

NOTE: We may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

Security

Expertus takes all necessary precautions to protect the data from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

Expertus applies the highest data-level security. We have physical and system security. We use firewalls and data encryption and apply strict procedures to protect the data we receive from unauthorized access or misuse. Only keys employees have access to data.

Integrity

Expertus takes reasonable steps to ensure that the Consumer Personal Data the company processes are (i) relevant for the purposes for which they are to be used, (ii) reliable for their intended use, and (iii) accurate, complete and current.

Access

Individuals may contact us either directly or through one of our clients, and after appropriate verification of their identity, can reasonably direct the correction or removal of data relating to them in our databases.

Choice

Expertus provides the individuals opt-in or opt-out choice before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized.

Enforcement

Expertus conducts an annual self-assessment to ensure compliance with this privacy policy and its data security obligations. If we change this privacy policy, we will post the changes on the Privacy Policy page so that you will always know what information we collect and how we use it.
